Rep. Stefani Carter Introduces Legislation to Protect Homeowners

Representative Stefani Carter (Dallas) has filed three bills that will protect homeowners in the home loan modification process.

WASHINGTON, D.C. – March 18, 2013 – (RealEstateRama) — House Bill 2864 protects homeowners by mandating that banks cannot foreclose on a property unless they show proof that the borrowers received the foreclosure notice by certified mail. This bill also requires that the mortgage servicers provide one point of contact for all dealings with consumers, thus reducing communication issues between the mortgage servicers’ offices and the borrowers. House Bill 2865 requires that borrowers be notified in writing of any changes to their home loan modification, which prevents confusing surrounding oral communications. House Bill 2567 protects homeowners by requiring that notice be given to homeowners if a mortgage company transfers the note to another person or company.

“The goal of these bills is to provide transparency between the homeowner and banks and to provide clearer and more timely information for those facing foreclosure,” stated Carter. “It’s time to stand with Texas homeowners.”

Stefani Carter is in her second term in the Texas House. Carter, a former prosecutor, is a graduate of the University of Texas at Austin and Harvard Law School.
